These Terms govern your use of byrisenmd.com, care.byrisenmd.com and the services offered through them (the "Services") by Risen Med LLC, a Florida limited liability company ("Risen MD", "we", "us"). By creating an account, starting an intake, or purchasing a program, you agree to these Terms, our Privacy Policy, our Notice of Privacy Practices and, for clinical services, the Telehealth Consent.

1. What Risen MD is — and is not

Risen MD provides access to telehealth programs: the website, the intake and checkout, care coordination, customer support and, where a program includes it, arranged fulfilment and shipping of prescribed medication.

Risen MD does not practice medicine and is not your health care provider. Medical services are provided by independent, licensed healthcare professionals who are licensed in your state and who exercise their own professional judgment. Risen MD does not employ those providers, does not supervise their clinical work, and does not direct, influence or control any diagnosis, treatment decision or prescription. Whether any treatment is appropriate for you — including whether anything is prescribed at all — is decided solely by a licensed provider after reviewing your information. A prescription or treatment is never guaranteed — it is always the provider's decision.

Prescribed medications are dispensed by licensed U.S. pharmacies. Some programs involve compounded medications, which are prepared by a licensed compounding pharmacy for an individual patient under a prescription and are not approved by the U.S. Food and Drug Administration and have not been evaluated by the FDA for safety, effectiveness or quality.

Telehealth. Telehealth is the delivery of health care using electronic communications between a provider and a patient who are not in the same place — questionnaires and records you submit, messages, and where used, audio or video visits. The Telehealth Consent, which describes its benefits, limits and risks, is incorporated into these Terms and you accept it when you begin an intake. You do not enter into a provider–patient relationship with Risen MD; that relationship is with the licensed provider who treats you. Except for communications from your provider, nothing you receive through the Services is medical advice.

Electronic communications and signatures. You agree that Risen MD and the providers and pharmacies that serve you may send you notices, disclosures, results, treatment communications and other messages electronically — through your account, your secure patient portal and by email (and text, if you opt in) — and that it is your responsibility to monitor them. A message that tells you something is waiting in your portal has done its job when it reaches you; not reading it, or not following a treatment recommendation in it, is not something you may hold Risen MD or your providers responsible for. Anything you sign or accept electronically through the Services has the same effect as a signature on paper.

Pharmacy. If a provider prescribes for you, the prescription is filled by a licensed U.S. pharmacy that serves the Services (where a program page or FAQ names the partner pharmacies, those) or, where the Services offer it, a pharmacy of your choice. You consent to Risen MD and your provider sending the dispensing pharmacy your prescription, the information you provided and the health and identifying information it needs to fill it. Mail-order medication may not arrive in child-resistant packaging. Keep all medication out of the reach of children.

Laboratory tests. For some programs — hormone support in particular — a provider may require laboratory results before prescribing or during treatment. Where a test is ordered through the Services, you will be told how the sample is collected (a local draw site or an at-home kit) and whether its cost is included in your program price or billed separately, before you agree to it. Results go to the ordering provider, who decides what they mean for your care and releases them to you through your portal; a laboratory result is not a diagnosis, and no provider–patient relationship with Risen MD arises from it. Where you already have recent results from your own physician, the provider may accept them instead.

2. What you are paying for

You pay Risen MD one price for your program, shown before you pay. Risen MD pays its independent clinical and fulfilment partners for the services they provide. Risen MD is responsible for the program, your account and your customer relationship; your care is delivered by the independent providers and pharmacies described above, who are your health care providers and the covered entities for your health information, and Risen MD handles that information on their behalf as a business associate.

3. Availability and eligibility

What the Services include. Depending on the program: general health and wellness information; the intake and the collection and retention of the information you provide for the provider's review and your care; access to independent licensed providers for consultations, assessments and treatment; arranged pharmacy fulfilment and shipping; and administrative support — scheduling, payment, and customer support.

Where. The Services are offered only to people located in the United States, in the states we serve at the time of your visit. We do not currently serve California or the District of Columbia; some programs are available in fewer states, and each program page checks your state before you start. If you access the Services from outside the United States you do so at your own risk and are responsible for complying with local law.

Who. By using the Services you represent that: you are at least 18; you are located in a state we serve; the information you provide is accurate, complete and current, including a valid photo ID when asked; you are using the Services for yourself only; and you agree to these Terms. Meeting these requirements does not mean you will receive treatment — that is always the provider's decision — and Risen MD and its provider partners may add eligibility requirements for a program without prior notice.

What you need. A compatible device, internet access and a current browser; your carrier's data and messaging charges are yours.

4. Not for emergencies

The Services are not for emergencies. If you may be experiencing a medical emergency, call 911 or go to the nearest emergency department. Providers may determine that a condition needs in-person care and direct you to it.

5. Your account

You are responsible for your login credentials and for everything done under your account. Tell us at support@risenmd.com immediately if you believe your account has been used without your permission.

6. Prices, payment and billing

Cash-pay; not insurance. By using the Services you are choosing to obtain products and services on a cash-pay basis, outside any commercial health insurance plan and outside any federal or state health care program, and you are solely responsible for their cost. Risen MD and the independent providers and pharmacies that serve you through the Services do not accept commercial health insurance, are not in-network with any plan, and are not enrolled in Medicare, Medicaid or any other federal or state health care program. Prices are shown per program and term before you pay. Care memberships are not health insurance and do not replace emergency, hospital or major medical coverage.

You agree that: (1) you will not seek payment or accept reimbursement, directly or indirectly, from any insurance plan or other third-party payer — including any federal or state health care program — for anything purchased through the Services, whether or not the payer would cover it; (2) if you are a beneficiary of a federal health care program, neither you nor Risen MD nor any provider or pharmacy that serves you through the Services will submit a claim to that program for these products or services; and (3) you will not count amounts you pay through the Services toward any insurance deductible or out-of-pocket maximum, and if you are enrolled in Medicare Part D you will not count them toward your Part D true out-of-pocket (TrOOP) costs.

Preauthorisation. When you check out for a treatment program, we place a temporary authorisation hold on your card for the program price. You are charged only if a licensed provider prescribes treatment for you. If the provider determines treatment is not appropriate, the hold is released and you are not charged. If the provider changes the treatment plan in a way that changes the price, you will see the adjusted price before anything is charged.

Prepaid multi-month programs. Where you choose a 3- or 6-month term, the total is charged once and the per-month price is locked for that term. Treatment programs do not auto-renew; continuing beyond your term is a new purchase that you make.

Care memberships. Care memberships are billed monthly on a recurring basis at the price shown until you cancel. You may cancel at any time before your next renewal date through your account or by emailing support@risenmd.com; cancellation stops future charges and does not refund the current period.

Card statement. Charges appear as Risen MD or leguprecovery.com, depending on which payment processor handles your program. Both are us.

Shipping is included in the price of medication programs. Delivery dates shown at checkout are estimates.

7. Refunds

See our Refund Policy, which is part of these Terms.

8. Communications

By providing your email address you agree that we may send you transactional messages about your account, intake, orders and shipments. If you opt in to text messages, you agree to receive transactional SMS from us at the number you provide — for example that a provider has sent you a message or a shipment is on its way; message and data rates may apply; reply STOP to opt out at any time. Consent to SMS is not a condition of purchase. Notifications tell you something is waiting in your secure patient portal and never contain its clinical content. We do not send marketing messages without your separate consent.

Email and text are not encrypted. Messages between you and Risen MD by email or SMS travel over networks we do not control and could be intercepted. That is why clinical communication happens inside your secure patient portal. If you choose to put health or other sensitive information in an email or text, you do so at your own risk. Neither Risen MD nor any carrier is responsible for delayed or undelivered messages.

9. Restrictions on use

In using the Services you agree that you will not, and will not attempt to or help anyone else to:

We may suspend or close an account, cancel an order and refuse future service for any of the above, in addition to any other remedy.

  • misrepresent your identity, age, location or health information, impersonate anyone, or use the Services on behalf of another person;
  • attempt to obtain a prescription by providing false or incomplete information, or resell, share, transfer or give any medication to anyone else;
  • violate any law, or use the Services for any unlawful purpose;
  • harass, threaten, abuse, defame or discriminate against any provider, pharmacist or support person who serves you through the Services;
  • access the Services with any robot, scraper or other automated means, or bypass any measure we use to restrict access;
  • probe, interfere with or breach the security of the Services or any connected system, or introduce any virus or harmful code;
  • reverse engineer, decompile or copy any part of the Services, or use their content to build a competing product or a database;
  • copy, reproduce, distribute, sell, license or commercially exploit the Services or their content beyond the personal use these Terms allow, frame the Services, or remove any notice or disclaimer from them;
  • post or transmit content that is unlawful, harmful, harassing, fraudulent, obscene, infringing, or that seeks the personal information of another user;
  • send advertising, spam or other unsolicited material through the Services;
  • use the Services in any way that exceeds the licence in Section 10.

10. Intellectual property

The Services and their content are owned by Risen MD or its licensors. You receive a limited, personal, non-transferable licence to use them for their intended purpose.

11. Disclaimer of warranties

YOU USE THE SERVICES AT YOUR OWN RISK. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, THE RISEN MD PARTIES (DEFINED IN SECTION 12) MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE SERVICES, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, ACCURACY, COMPLETENESS, TIMELINESS OR RELIABILITY, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR FREE OF ERRORS, DEFECTS, DELAYS, VIRUSES, MALWARE OR OTHER SECURITY INTRUSIONS.

Information on the website is for general education. It is not medical advice, and reading it does not create a provider–patient relationship; only a licensed provider who has reviewed your information can advise you about your health. You are responsible for evaluating any content you obtain through the Services and for any loss that results from relying on it, and for any damage to your device or data from downloading it. Results of any treatment vary and are never guaranteed. The professional services of licensed providers and pharmacies are theirs, provided under their own professional standards; the Risen MD Parties make no warranty about them.

12. Limitation of liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT AS THIS SECTION PROVIDES, RISEN MED LLC, ITS AFFILIATES, LICENSORS AND SUPPLIERS, AND THEIR OWNERS, OFFICERS, EMPLOYEES AND AGENTS ("RISEN MD PARTIES") WILL NOT BE LIABLE TO YOU OR ANYONE ELSE, UNDER ANY THEORY — CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, STATUTE OR OTHERWISE — FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR LOSS OF REVENUE, PROFITS, GOODWILL, USE OR DATA, SERVICE INTERRUPTION, DEVICE OR SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICES OR THEIR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF THE RISEN MD PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES, IN THE AGGREGATE, WILL NOT EXCEED THE GREATER OF (I) ONE HUNDRED DOLLARS ($100) OR (II) THE AMOUNT YOU PAID RISEN MD FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

Medical care is the providers' responsibility, not ours to limit. The Risen MD Parties do not practice medicine (Section 1). Claims about the professional services of a licensed provider or pharmacy — including claims for personal or bodily injury arising from diagnosis, treatment, prescribing or dispensing — are between you and that provider or pharmacy, and nothing in this Section limits or affects them.

Some states do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of these limitations may not apply to you. Where a state permits them (including for residents of New Jersey), they apply to the fullest extent permitted. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or wilful misconduct.

13. Indemnification

You agree to indemnify, defend and hold harmless Risen Med LLC, its affiliates and subsidiaries, the independent providers, provider groups and pharmacies that serve you through the Services, and each of their owners, directors, officers, employees, contractors, licensors, suppliers, agents, successors and assigns, from and against any third-party claim, suit, proceeding, loss, liability, judgment, settlement, cost or expense — including reasonable attorneys' fees — arising out of or alleged to arise out of (i) your use of the Services in a manner these Terms do not permit, (ii) your fraud, violation of law, negligence or wilful misconduct — including providing false identity, location or health information — or (iii) your breach of these Terms. Risen MD may take over the defence of any matter otherwise subject to indemnification by you, at its expense, and you agree to cooperate.

14. Dispute resolution — binding arbitration and class-action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM IN COURT AND TO PARTICIPATE IN A CLASS ACTION.

14.1 Governing law. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and by the Federal Arbitration Act as to this Section 14.

14.2 Talk to us first. Before starting any formal proceeding, you and Risen MD agree to try to resolve the dispute informally. Send a written description of the dispute — your name, the email on your account, what happened, and what you are asking for — to support@risenmd.com; if Risen MD has a dispute with you, we will send the same to the email on your account. Both sides agree to negotiate in good faith for 60 days from receipt. Any limitation period is paused while we do. Completing this step is a condition of starting arbitration or a lawsuit.

14.3 Binding individual arbitration. If the dispute is not resolved within 60 days, any claim arising out of or relating to these Terms or the Services — including whether a claim is arbitrable — will be resolved by binding arbitration before a single arbitrator, administered by the American Arbitration Association under its Consumer Arbitration Rules (or, if the AAA is unavailable, a comparable provider the parties agree on), and not in court. The arbitrator may award any relief a court could award to an individual. Claims of $10,000 or less are decided on the documents unless the arbitrator decides a hearing is needed; any hearing is by video or phone unless both sides agree otherwise. Arbitration takes place in the county where you live. Judgment on the award may be entered in any court with jurisdiction.

14.4 No class actions; no jury. You and Risen MD each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated or representative proceeding, and each waives the right to a jury trial. If a court finds this waiver unenforceable for a particular claim or remedy, that claim or remedy is severed to court and the rest of the dispute stays in arbitration.

14.5 What is not covered. Either side may bring an individual claim in small-claims court if it qualifies. Either side may seek an injunction or other equitable relief in court to protect intellectual property or to stop unauthorised use of the Services. Claims about the professional services of a licensed provider are between you and that provider and are not governed by this Section.

14.6 Your 30-day right to opt out. You may opt out of this arbitration agreement by emailing support@risenmd.com within 30 days of first accepting these Terms, with your name and account email and a statement that you opt out. If you opt out, neither you nor Risen MD is bound by this Section 14, and disputes not resolved under 14.2 are brought in the state or federal courts in Hillsborough County, Florida, whose jurisdiction you accept.

14.7 Changes to this Section. We will give 30 days' notice by email of any material change to this Section. Changes apply only to claims filed after they take effect; if you do not agree, you may opt out under 14.6 within those 30 days.

14.8 Costs. Fees follow the provider's consumer rules; Risen MD pays its own share and any share the rules assign to it. Each side pays its own attorneys' fees unless the rules or applicable law provide otherwise. The arbitrator may sanction a claim brought in bad faith.

15. Changes to these Terms

We may update these Terms; the effective date at the top changes when we do, and material changes are notified to account holders by email before they take effect. Continued use after the effective date is acceptance.

17. Miscellaneous

No waiver. If Risen MD does not enforce a term, that is not a waiver of it. Assignment. You may not assign these Terms; Risen MD may assign them to a successor in a merger, acquisition or sale of the business, with notice to you. Relationship. Nothing here creates a partnership, employment or agency relationship between you and Risen MD. Severability. If any provision is unenforceable, the rest remains in effect. Entire agreement. These Terms, the Refund Policy, the Privacy Policy, the Notice of Privacy Practices and the Telehealth Consent are the whole agreement between you and Risen MD about the Services. Headings are for convenience only.

The federal Physician Payments Sunshine Act requires that detailed information about payments and other transfers of value from applicable manufacturers and group purchasing organizations to physicians and teaching hospitals be made available to the public.
